Welcome to Allies for Allies’ website (www.alliesforallies.org) (the “Website”). Your privacy is important to Allies for Allies (“Allies for Allies,” “we,” “us,” or “our”). We are committed to respecting the privacy of all who visit our Website. This Privacy Policy and Terms of Use covers, among other things, information that we collect about you when you visit and interact with our Website and describes how we collect, use, share, and protect that information. By accessing the Website, you acknowledge and agree to this Privacy Policy and Terms of Use, and consent to the practices described in this Privacy Policy and Terms of Use. 1. INFORMATION COLLECTED.
   • Information That You Provide. Depending on how you use the Website and related functionality, you may voluntarily choose to provide to us or others personal information about you, which includes any information that identifies or can be used to identify, contact, or locate you (“Personal Information”). Examples include your name, address, telephone number, and e-mail address. Whether you choose to share your Personal Information is completely up to you, but please keep in mind that you may not be able to effectively use parts of the Website and related functionality without sharing your Personal Information. Below are some examples of when Personal Information may be collected from you.
     • Online Store. The Website has an online store (the “Store”) at https://alliesforallies.org/. Store transactions are processed by Shopify Inc. (“Shopify”), an independent third party. If you wish to make a purchase through the Store, Shopify will collect Personal Information such as your name, email address, phone number, shipping address, billing address, and payment information. Shopify will disclose to us your Personal Information necessary to fulfill your order. Your online purchase and the Personal Information provided to Shopify will be subject to its terms of service https://www.shopify.com/legal/terms) and privacy policy https://www.shopify.com/legal/privacy). The payment information that you provide in connection with a purchase is not stored by us, but is stored and used by Shopify, for it to process your purchase. By clicking the “Pay now” button on the “Check Out” page, you authorize Shopify to charge your form of payment and to process your transaction.
     • Donations. We will collect certain Personal Information from you through Allies for Allies’ “Donate” page. Such Personal Information includes your name, address, phone number, and email address. Online donation transactions on the “Donate” page are processed by Payment-As-A-Service Corporation, D/B/A Click & Pledge (“Click & Pledge”). If you wish to make an online donation, your Personal Information relating to such donation will be collected by Click & Pledge and Tides Foundation. Allies for Allies Champion Fund is a Single Entity Fund of Tides Foundation, a 501(c)(3) nonprofit organization (EIN 51-0198509).   Your online donation and the Personal Information collected by Click & Pledge and Tides Foundation will be subject to their respective terms of use (https://clickandpledge.com/termsofuse/ and https://www.tides.org/terms-and-conditions/) and privacy policies (https://clickandpledge.com/privacy/ and https://www.tides.org/privacy-policy/). The payment information that you provide in connection with a donation is not stored by us, but is stored and used by Click & Pledge, for it to process your donation. By clicking the “Submit Donation” button on the “Donate” page, you authorize Click & Pledge to charge your form of payment and to process your donation.
     • Correspondence With Us. You may provide Allies for Allies with your Personal Information such as your name and email address if you fill out the contact form available at alliesforallies.org/pages/contact. The Website also contains email links to contact us, and you may elect to include Personal Information in communications that you send to us through those links.
     • Updates. We will collect your email address if you fill out the form on the footer of the Website to receive our updates.
   • Information We Collect As You Access Our Website. In addition to any Personal Information or other information you choose to submit to us, we and our third-party service providers may use a variety of technologies that collect certain non-Personal Information whenever you visit our Website (“Usage Information”). Methods that we use to collect Usage Information include the following:
     • Cookies. A cookie is a small text file stored by your browser that allows the Website to “remember” your preferences on the Website from visit to visit. Usage of a cookie is in no way linked to any Personal Information while on our Website. You may confirm your Website cookie preferences in the Website’s cookies banner. Web browsers also have settings allowing you to reject cookies, or selectively accept cookies, or delete cookies previously accepted. Please be aware that rejecting or deleting cookies from our Website may make certain functions unavailable to you.
     • Online Tracking; Do Not Track Signals. Some web browsers have a “Do Not Track” feature. This feature lets you tell websites you visit that you do not want to have your online activity tracked. These features are not yet uniform across browsers. We do not engage in online tracking of our users (i.e., the collection of personal information about a user’s online activities over time and across third party websites or online services), and therefore, the Website is not currently set up to respond to “Do Not Track” signals. We also do not authorize third parties to collect Personal Information about an individual user’s online activities over time and across different websites when a user uses the Website.

2. USE OF COLLECTED INFORMATION. Our primary goal in collecting your Personal Information is to respond to and fulfill your requests of us, or to help you use the Website. For example, we will use your Personal Information to communicate with you about your Store transactions or to process an online donation. We may use technical information to analyze trends, administer and improve the Website, and monitor traffic and usage patterns for information security purposes. In addition, your Personal Information may also be used as required by law.

   • Service Providers. We may share your Personal Information with companies that perform services for us or our partners we use to support our business. They have access to Personal Information as needed to perform their functions but may not disclose your information for other purposes.

Please note that you cannot opt-out of receiving transaction-related emails from us.
5. LINKS. The Website may contain links to other websites not otherwise listed in this Privacy Policy and Terms of Use. The use of other websites and the Personal Information collected by them are subject to their respective terms of use or service and privacy policies.

Please be aware that we are not responsible for the privacy practices of third party websites. We encourage you to be aware when you leave our Website and to read the privacy policy of any other website that collects your Personal Information. This Privacy Policy and Terms of Use applies solely to information collected by this Website. We are not responsible for any fees charged, charges applied, or actions taken by any third party website.

6. RETENTION. We may retain your Personal Information on internal servers for as long as the information is required to fulfill our legitimate business needs, the purposes for which the Personal Information was collected, to comply with legal obligations, or for such other period as required by law.
7. SECURITY. We take the security of your Personal Information seriously and take precautions to protect your Personal Information located on our internal servers. For example, we use standard, industry-wide, commercially reasonable security practices such as encryption, firewalls and SSL (Secure Socket Layers) to protect Personal Information. But no method of data transmission over the Internet or data storage is 100% secure and therefore we cannot guarantee the absolute security of any information on our internal servers or transmitted to or from the Website. You must maintain the security of your information as well – for example, by not sharing your transaction order number with any unauthorized parties.
8. AGE RESTRICTION. We do not knowingly collect Personal Information from individuals under 13. If you become aware that your child under the age of 13 has provided us with Personal Information, please contact us. If we become aware that an individual under 13 has provided us with Personal Information, we will take steps to remove such information.
9. ACCESSING THIS SITE FROM OUTSIDE OF THE UNITED STATES. If you are visiting our Website from outside the United States, please be aware that your information may be transferred to, stored, or processed in the United States, where our servers are located, and our central database is operated. The data protection and other laws of the United States might not be as comprehensive as those in your country. 10. MODIFICATIONS TO THE WEBSITE AND TO PRICES. We reserve the right at any time to modify or discontinue the Website (or any part or content thereof) without notice at any time. Prices for the products available through the Store are subject to change without notice. We will not be liable to you or to any third-party modification, suspension, or discontinuance of the Website or for any price change for products available through the Store.
11. DONATIONS. You may make a donation to support Allies for Allies through the Website.  By making a donation, you acknowledge and agree that your donation will be made to Allies for Allies Champion Fund, a Single Entity Fund of Tides Foundation, a 501(c)(3) nonprofit organization (EIN 51-0198509) and a California nonprofit public benefit corporation (“Tides Foundation”).  Donations made to Allies for Allies Champion Fund may be tax-deductible pursuant to §170(c) of the Internal Revenue Code. 12. PRODUCTS. Products available through the Store may have limited quantities and are subject to exchange only according to our Exchange Policy. To view our Exchange Policy, please visit https://alliesforallies.org. We have made every effort to display as accurately as possible the colors and images of the products that appear available through the Store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of the products available through the Store to any person, geographic region, or jurisdiction, to the maximum extent permitted by applicable law. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products offered through the Store. All descriptions of products or product pricing are subject to change at anytime without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product available through the Store is void where prohibited.

We do not warrant that the quality of any products, information, or other material purchased or obtained by you in connection with this Website will meet your expectations, or that any errors in the products will be corrected.

13. ACCURACY OF BILLING AND ACCOUNT INFORMATION. We reserve the right to refuse any order you place through the Store. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer name, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase information for all purchases made through the Store so that your transactions can be fulfilled and that you can be contacted as needed.

All materials published on the Website, including but not limited to written content, photographs, graphics, images, illustrations, marks, logos, sound or video clips, and animation, are owned by Allies for Allies or its licensors, and are protected by U.S. and international laws, including laws governing copyrights and trademarks.

Allies for Allies’ logo, name, and all custom graphics on the Website are service marks, trademarks, and/or trade dress of Allies for Allies, and may not be used in connection with any product or service that is not offered by Allies for Allies without Allies for Allies’ written permission. 15. NO UNLAWFUL OR PROHIBITED USE. As a condition of your use of the Website, you warrant to Allies for Allies that you will not use the Website for any purpose that is unlawful or prohibited by this Privacy Policy and Terms of Use. You may not use the Website in any manner which could damage, disable, overburden, or impair the Website or interfere with any other party’s use and enjoyment of the Website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Website.
16. LIMITATION OF LIABILITY; DISCLAIMER OF WARRANTIES. Allies for Allies maintains this Website to promote Allies for Allies and provide the latest news and information about Allies for Allies. Our goal is to keep the Website timely and accurate. If errors are brought to our attention, we will try to correct them. However, Allies for Allies accepts no responsibility or liability whatsoever with regard to the information on the Website and makes no representations about the suitability of the information contained on the Website for any purpose or audience. Under no circumstances, including, but not limited to, negligence, will Allies for Allies be liable for any direct, indirect, incidental, special, or consequential damages that result from purchasing any product through the Store or the use of, or the inability to use, this Website. You specifically acknowledge and agree that Allies for Allies is not liable for any defamatory, offensive, or illegal conduct of any user. California law governs this Privacy Policy and Terms of Use, as well as any claim, cause of action or dispute that might arise between you and Allies for Allies relating to the Website without regard to conflict of law provisions. For any such claim, cause of action, or dispute, you agree and consent to the exclusive jurisdiction and venue of the state and federal courts of the State of California, City and County of San Francisco. You are responsible for complying with the laws of the jurisdiction from which you are accessing the Website and you agree that you will not access or use the information on the Website in violation of any applicable laws.
